中文摘要
如今随着经济的快速发展,一系列的环境问题也随之而来。干旱、地震、土地荒漠化等一系列的自然或人为灾害造成了大量的环境难民。环境难民问题已经成为了全球人民都不得不面对的一个严峻问题,数以千万计的环境难民面临着背井离乡无家可归的境地。
但是由于目前国际上对环境难民保护方面的研究存在一定的滞后性,现有的难民保护体系并没有将环境难民纳入其中,所以环境难民并不能得到与传统难民相同的法律强制约束下的援助。本文试从国际法的角度出发,通过对环境难民定义和保护原则的介绍引申出环境难民保护过程中存在的问题,经过分析考察现有国际法律规范中保护环境难民的法律依据从而论证并提出解决环境难民的的国际法途径。
论文主要包括四个部分:
第一部分是对环境难民基本理论的介绍。包括环境难民的概念和根据三种不同标准对环境难民的分类以及环境难民产生的两种原因。
第二部分是环境难民保护制度方面的总结。这一部分主要是对环境难民的保护主体、原则和保护内容三个方面的介绍,通过对现有保护制度的研究进而揭示了环境难民保护中的问题之所在。
第三部分是对环境难民保护的国际法律依据进行分析论证,通过对现有的国际人权法、国际环境法以及难民公约等法律文件中的有关规定进行分析,从而为下文提出解决环境难民问题的措施提供理论支撑。
第四部分主要是通过对环境难民保护过程中存在的几个问题进行描述进而针对这几类问题提出了相应的解决对策。

Abstract
With the rapid development of economy, a series of environmental problemshappened frequently. For instance, many natural or man-made disasters like earthquake,typhoon, drought, desertification, contributed to an increasing number of environmentalrefugees which was an extremely severe issue for countries all over the world.
Thousands of environmental refugees had to leave their motherlands and becomehomeless.
As a result of the lagging research in environmental refugees’ protection,theexisting refugee protection system were not open to the environmental refugees. Thus,they cannot enjoy the same aid as traditional refogees whose aid was maintained by lawconstraints. This thesis is based on the International Law, through study the definitionand protection principles of environmental refugees to figure out the problems in theprocess of environmental protection. By analyzing the legal basis for the protection ofenvironmental refugees in existing international legal norms, in order to propose anddemonstrate a way that the problem can be solved with the International Law.
This thesis is divided into four parts:
The first part is an introduction of environmental refugees’ basic theories.
Including the concept and classification of environmental refugees based on threedifferent criteria as well as two causes of the problem.
The second part summarized the protection system of environmental refugees. Thissection consists of three factors: protection subject, principles and content of theenvironmental refugees. By means of the study of existing protection system to revealthe matters in the protection procedure.
The third part is an analysis of the international legal basis for the protection ofenvironmental refugees. Through analyzing the present International Human RightsLaw, International Environmental Law, refugee conventions and other legal documentsin the relevant provisions so as to provide the theoretical support of policies which Iwould illuminate below.
Several issues that during the protection process are going to be demonstrated in the last part. Aiming at these problems, some corresponding strategies are expoxmded.
