随着近年来我国离婚率的不断增加，关于未成年子女的探望、抚养等民事纠纷也日益增多，逐渐成为一种社会问题引起了全社会的关注。我国的《婚姻法》于2001年对探望权制度进行了明确的法律规定，填补了我国婚姻家庭法律制度中这方面的空白。如今探望权制度已运行了 10余年，在司法实践工作中暴露出这项制度的设计与现实的多样性之间存在诸多矛盾，使得探望权的执行方面往往难以尽如人意，还需要作进一步的探讨和完善。
本文约2. 3万字，除前言外共有四个部分。
第一部分，是对目前我国探望权立法情况及其强制执行基本原理的论述。结合探望权的性质、主体、内容和行使方式，对探望权执行的标的、原则、特点等进行分析说明。
第二部分，是对探望权执行困境的审视与解读。罗列了探望权执行所面临的现实困难表现，并从立法上的不足、社会环境的影响、传统现实因素的制约、自身情况的限制等等多个角度和层面分析了陷入困境的必然性或偶然性的因素。
第三部分，是对国外探望权执行制度的比较分析。通过对英美法系和大陆法系典型国家的探望权执行制度的介绍，分析比较各自的特点及优劣，并结合我国司法制度的实际，从中梳理出可供借鉴和吸收的内容。
第四部分，是对我国探望权执行制度如何进行完善的思考。通过分析立法制度与现实困境之间的错位，找出立法制度上的不足，提出有关的建议进行补充完善。在操作措施上结合现实和未来的实际，罗列出一些可行的具体办法，以保障探望权执行的效果。

ABSTRACT
With the increasing divorce rate during the last several years in China, civil disputesregarding raising and visiting minor children after divorce has increased, and causedwidely attentions in community being a social problem. The vacancy in the legal system ofmarriage and family has been filled up since 2001,when the articles on Visitation Rightbeing carried out and clearly stated as a legal provision in China's “marriage law”.
However, further discussions and improvements are in need to be applied to the currentlegal Visitation, giving consideration after performing the “Visitation Right” for nearly adecade, more and more contradictions between the original design and the diversity ofreality have come to surface in the judicial practice, making the execution flawed andimperfect in many ways.
This paper contains approximately 230 thousand words, divided into four parts.
Part I primarily states the basic principles of legislation and current enforcement ofVisitation in China, and analyzes the objects,principles and characteristics of Visitationimplementation combined with the nature, subject, content and implementation patterns.
Part II discusses and comprehends the dilemma during execution of Visitation. Thesection lists the difficulties irx real practice, and analyzes inevitable and accidental factorscontributed to getting it in to dilemma, based on facts of the legislation insufficiency,influence of social environment, restriction of traditional realistic factors, self-limitationand etc.
Part III presents a compare to the foreign systems on Visitation Execution. Withintroductions of Visitation Execution in both the Anglo-American law and continental lawsystems,the section compares their advantages and disadvantages, combined with theactual conditions of China's judicial system, teasing out and absorbing flash points can beused for reference.
Part IV takes the whole discussion deeper by brainstorming the way to improveVisitation Execution in China. By analyzing the dislocation between legislation anddilemma in reality, author seeks for insufficiencies in the legislation process, carries outrelevant suggestions on improving the system,and lists some feasible specific measuresbased on the realities currently and prospectively, in order to ensure the effectiveness ofVisitation.
